30-Day Notice In instances where per month-to-month tenant does not re-locate after you have ended the tenancy, you can utilize a 30-day notice when the month-to-month tenant has resided in the property for under annually. When the tenant has resided in the property for over a year, you have to provide a 60-day notice (even when the tenant pays bi-weekly or weekly). A 90-day notice is needed for many government-subsidized tenancies. The needs for service are basically exactly the same for a 3-day notice. The 30-, 60- and 90-day notices are most suitable where you need to evict tenant for any small breach, minor nuisance/damage or without just cause (in case your jurisdiction enables evictions without just cause).

North Park enables eviction without just cause, only for tenants who've were living in the property for under 2 yrs. North Park Municipal Code Sec. 98.0730. Santa Monica, La, Beverly Hillsides, West Hollywood, Glendale, Palm Springs and Bay Area don't permit evictions without just cause. This means that a landlord may evict just for reasons enumerated within the relevant laws. The typical reasons are nonpayment of rent, nuisance, refusal to provide landlord reasonable use of property, unauthorized subtenants, etc. It's often better to utilize a three-day notice in the event of nonpayment of rent. After you have offered the 30- or 60-day notice, you have to wait 30 or two months before filing your illegal detainer complaint. A judge will often hear and resolve the situation within twenty times of filing. California Code of Civil Procedure Section 1170.5(a). When the decision is to your benefit, the judge will problem a writ of possession (California Code of Civil Procedure Sections 712.010 and 715.010.) which orders the sheriff to get rid of the tenant from property when the latter doesn't leave under your own accord within 5 days.
